These Terms and Conditions ("Terms") govern your use of the website (https://www.courtneymarieimaging.com) (the "Site") and any services provided by Courtney Marie Imaging ("we," "us," or "our"). By accessing this Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Website
You agree to use this Site for lawful purposes only and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Site. You may not misuse the Site by introducing viruses, attempting unauthorized access, or engaging in any activity that could harm the Site or our business.
2. Photography Services
Courtney Marie Imaging provides professional photography services, including but not limited to weddings, elopements, engagements, branding, portraiture, boudoir, family and lifestyle sessions. All services are subject to availability and confirmation through a signed agreement and payment of a retainer.
Specific details regarding coverage, deliverables, timelines, pricing, and usage rights are outlined in individual client contracts and invoices. In the event of a conflict between these Terms and a signed client agreement, the signed agreement shall prevail.
3. Booking, Payments & Retainers
* A booking is not considered confirmed until a contract is signed and the required retainer is received.
* Retainers are non-refundable unless otherwise stated in writing.
* Final balances must be paid according to the schedule outlined in your contract or invoice.
* Payments are processed through third-party platforms such as HoneyBook, Stripe, PayPal, or Apple Payments.
We do not store or process payment information directly.
4. Cancellations, Rescheduling & Force Majeure
Cancellation and rescheduling policies are outlined in your individual client contract.
Courtney Marie Imaging shall not be held liable for failure to perform services due to circumstances beyond our control, including but not limited to acts of God, illness, government restrictions, natural disasters, or other emergencies. In such cases, reasonable efforts will be made to reschedule or provide an appropriate solution as outlined in your contract.
5. Intellectual Property & Image Use
All photographs, images, and content created by Courtney Marie Imaging remain the intellectual property of Courtney Marie Imaging.
Clients are granted a personal-use license ("print release") unless otherwise stated in writing. This allows clients to print, share, and display images for personal, non-commercial use. Commercial use, publication, or alteration of images without written consent is prohibited.
Courtney Marie Imaging reserves the right to use images for portfolio, website, social media, marketing, and promotional purposes unless otherwise agreed upon in writing.
6. Website Content & Copyright
All content on this Site, including text, images, branding, logos, and design elements, is the property of Courtney Marie Imaging and may not be copied, reproduced, or used without prior written permission.
7. Limitation of Liability
To the fullest extent permitted by law, Courtney Marie Imaging shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of this Site or our services. Our total liability shall not exceed the amount paid for the services giving rise to the claim.
8. Client Responsibilities
Clients are responsible for:
* Providing accurate information
* Securing necessary permissions for photography locations
* Informing Courtney Marie Imaging of any restrictions or special requirements
Courtney Marie Imaging is not responsible for missed shots due to circumstances beyond our control, including late schedules, uncooperative subjects, venue restrictions, vendor restrictions, or weather conditions.
9. Third-Party Links & Services
This Site may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third-party sites.
10. Privacy
Your use of this Site is also governed by our Privacy Policy. By using the Site, you consent to the collection and use of information as described in that policy.
11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
